How can an executor prepare before the testator dies?

Becoming someone else’s executor can be a significant duty, often involving various responsibilities that become urgent once the testator dies. Preparing could be crucial if the situation involves complex asset types and circumstances.

There may be limited methods to do so when the testator is still alive. Still, these preparations can be beneficial, especially when you foresee issues that could lead to legal obstacles. If you are an appointed executor, consider working with the testator during their life and complete the following tasks:

  • Create a list of vital documents, indicating what and where they are.
  • Establish joint ownership of real estate properties and financial accounts, which may make sense if the testator is your spouse.
  • Ask the testator essential questions about their preferences and other details of what happens after their death.
  • Draft and regularly update the list of assets, including information about who their beneficiaries will be when the testator passes away.
  • Revisit all relevant information at least once a year to update any details in case the testator changes their mind during their life.
  • Place all necessary paperwork in a sealed envelope, storing it somewhere safe.

These measures might not ensure an easy probate process after the testator dies, but they could significantly reduce the stress when organizing vital information. However, some situations can still result in complications, no matter how much you plan.

Skilled insight and assistance can also help you as the appointed executor, especially when your estate administration responsibilities become overwhelming.
